• Jenkins win record-breaking opposition

We are pleased to announce our success in an opposition to European Patent No. 1220114. The patent, which concerned an electronic data interchange (EDI) system for invoices, was revoked during a hearing held at the European Patent Office (EPO) on 5 April 2011. The case was handled by Jenkins partners David Musker and Philip Cupitt.

This case is notable because nineteen parties opposed the patent, which is believed to be a record for opposition proceedings at the EPO. The previous record is believed to have been held by the notorious Harvard Oncomouse patent (European Patent No. 0169672), against which 'only' seventeen valid oppositions were filed.

Opposition proceedings are an inexpensive way of having a European patent revoked in all of the countries in which it is in force. Jenkins have a strong track record in opposition proceedings for a wide range of technologies, including software, telecommunications and electronics. We would be pleased to assist any clients who are interested opposing their competitors' patents.
