Most of the development of the 20th century is now off-patent and public domain or in the last years of patent protection, but industry and innovation does not rest. The more competitive an industry becomes, the more hard-fought are the battles over each incremental improvement. This is why we are continually called upon to monitor competitors’ patent portfolios, identify potential strengths and weaknesses, give opinions on freedom to operate and pursue those who are infringing our clients’ intellectual property rights.
Our experience in the field of engineering is that patent offices are issuing patents at a higher rate than ever, and are as receptive as ever to arguments that improvements, even those which on their face may look small, are worthy of patent protection.
